Terms of Service

These terms govern your use of SerenityLease. By creating an account you agree to them.

This document is a starting-point template, not legal advice. Have a licensed attorney review and adapt it for your business before relying on it in production.

1. Acceptance of terms

By accessing or using SerenityLease (the “Service”), operated by SerenityLease, Inc. (“we,” “us”), you agree to these Terms of Service. If you are using the Service on behalf of a company, you represent that you are authorized to bind that company.

2. Accounts and eligibility

You must be at least 18 and provide accurate information. You are responsible for safeguarding your credentials and for all activity under your account, including teammates you invite to your organization. Notify us promptly of any unauthorized use.

3. Subscriptions, billing, and trials

Landlord/management accounts are offered on paid subscription plans by portfolio size. Paid plans may begin with a free trial. When a trial ends, the subscription renews automatically at the then-current price until cancelled. Payments are processed by Stripe; by subscribing you also agree to Stripe’s terms. You can change or cancel your plan anytime from the billing portal; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. Tenants use the Service at no charge.

4. Acceptable use

You agree not to misuse the Service, including: violating any law; infringing others’ rights; uploading malicious code; attempting to access data that isn’t yours; or using the Service to discriminate against any person. We may suspend accounts that violate these terms.

5. Landlord responsibilities and legal compliance

SerenityLease is a software tool, not a party to any lease, application, or rental decision. If you are a landlord or property manager, you are solely responsible for complying with all applicable laws — including federal, state, and local fair-housing laws, the Fair Credit Reporting Act, security-deposit and rent-control rules, and required disclosures. You are responsible for the decisions you make using information surfaced by the Service. See our Fair Housing and FCRA notices.

6. Tenant screening

Screening (credit, criminal, eviction) is performed by an independent, FCRA-credentialed provider, not by SerenityLease. We are not a consumer reporting agency. The applicant authorizes and pays the provider directly; we do not collect or store applicants’ Social Security numbers or full credit data.

7. Your content and data

You retain ownership of the data you upload. You grant us a limited license to host and process it to provide the Service. Our handling of personal data is described in our Privacy Policy.

8. Third-party services

The Service integrates third parties such as Stripe (payments), screening providers, email/SMS providers, cloud hosting and storage, mapping, and social platforms you choose to connect. Your use of those features may be subject to the third party’s own terms, and we aren’t responsible for their acts or omissions.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not provide legal, tax, or financial advice, and informational content (including the Rental Law Center) is not a substitute for professional counsel.

10. Limitation of liability

To the maximum extent permitted by law, SerenityLease will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these terms or to comply with law. Certain provisions survive termination, including disclaimers, limitation of liability, and indemnification.

13. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Venue for disputes lies in the state or federal courts located in California.
